General Entry Rules

All entries—whether submitted via online entry or AMOE—are treated equally for purposes of the random drawing.

College Transitions LLC reserves the right to exclude or remove any Entrant from the Sweepstakes, or withhold any prize, if the Entrant is found to have violated these Official Rules, College Transitions LLC’s Terms & Conditions, Privacy Policy, or any other published policy or disclaimer available on gateway.collegetransitions.com. College Transitions LLC further reserves the right to suspend, modify, or cancel the Sweepstakes for any reason, in its sole and absolute discretion.

6. Limits of Entry

All rules, guidelines, and Terms and Conditions of College Transitions LLC apply. By entering, the Entrant—or, if applicable, the Minor Entrant’s parent or legal guardian—confirms their full acceptance of and agreement to these Official Rules and any additional rules or conditions expressly provided by College Transitions LLC.

The use of any device, software, bot, script, or automated system to participate in the Sweepstakes is strictly prohibited. Entries generated through automated means, or entries that exceed the stated entry limits, or that are incomplete, illegible, corrupted, damaged, forged, late, lost, deceptive, or otherwise not in compliance with these Official Rules, may be disqualified at College Transitions LLC’s sole and absolute discretion.

College Transitions LLC is not responsible for incorrect, incomplete, illegible, corrupted, damaged, forged, or inaccurate entry information submitted by the Entrant or, if applicable, by a Minor Entrant’s parent or legal guardian. Any such invalid entries will be void.

College Transitions LLC may conduct multiple sweepstakes, contests, or promotions simultaneously. Entry into this Sweepstakes does not constitute entry into any other sweepstakes, contest, or promotion administered by College Transitions LLC.

7. Prize Drawing

Within fifteen (15) days of the end of each Entry Period (see dates in the chart above), College Transitions LLC (operating the CT Gateway brand) (“Sponsor”) will select one (1) potential winner in a random drawing from among all eligible entries received during that Entry Period. One (1) winner will be selected for each Entry Period. Each drawing will occur on or about the corresponding date listed in the chart above. All drawings will be conducted by College Transitions LLC, whose decisions are final and binding in all matters related to this Sweepstakes.

The odds of winning depend on the total number of eligible entries received during the applicable Entry Period. College Transitions LLC will attempt to notify the potential winner via email on or about the applicable drawing date. If the potential winner cannot be contacted, does not respond within five (5) days of the initial contact attempt, fails to provide required documentation, is determined to be ineligible, or declines the prize, College Transitions LLC may select an alternate potential winner at random from the remaining eligible, non-winning entries for the applicable Entry Period.

8. Winner Notification

The potential winner will be notified by email, mail, or phone. Each potential winner (or parent/legal guardian if the potential winner is a minor in his/her state of residence) will be required to complete, electronically sign, and submit within seven (7) days of notification an Affidavit of Eligibility, a Liability Waiver, an IRS Form W-9, and, where permitted, a Publicity Release (collectively, the “Releases”). These Releases may require the winner to provide a Social Security Number solely for the purpose of tax reporting, as required by law.

Where applicable, the potential winner may also be required to submit proof of current enrollment in an accredited high school, college, or university in the United States before any prize is awarded.

A Declaration of Compliance may additionally be required and must be returned within five (5) days of notice or attempted notice. Failure to submit the Declaration of Compliance or any other required documentation within the stated timeframes, inability to contact the potential winner, or return of the prize notification as undeliverable will result in forfeiture of the prize.

If a potential winner is at least eighteen (18) years of age but considered a minor in his/her jurisdiction of residence, College Transitions LLC (“CT Gateway” or “Sponsor”) reserves the right to award the prize to the parent or legal guardian, who must sign all required documentation on the potential winner’s behalf and satisfy all other requirements.

Potential winners must continue to comply with all terms of these Official Rules, and winning is contingent upon the timely fulfillment of all requirements. If a potential winner is disqualified for any reason, College Transitions LLC will select an alternate winner by random drawing from the remaining eligible entries. Only two (2) alternate drawings will be conducted. After two unsuccessful attempts to verify an alternate winner, the prize will remain unawarded.

Prizes will be fulfilled approximately six (6) to eight (8) weeks after the conclusion of the Sweepstakes or after completion of all required winner documents, whichever is later.

9. Prizes and Odds

One (1) Winner will receive a $2,000 (USD) CT Gateway Scholarship Award. The cash prize will be paid via check or through an electronic funds transfer method selected by College Transitions LLC (“CT Gateway”). The Approximate Retail Value (“ARV”) of the Prize is $2,000 USD.

The odds of winning depend on the number and timing of eligible entries received during the applicable Entry Period and cannot be determined in advance.

No substitution, transfer, or cash redemption of the Prize or any portion thereof is permitted, except at the sole discretion of College Transitions LLC. College Transitions LLC reserves the right to substitute the Prize, or any portion of the Prize, with a prize of equal or greater value if the advertised Prize becomes unavailable for any reason. Any unused or unclaimed portion of the Prize will not be refunded or otherwise compensated. All Prize details are at the sole discretion of College Transitions LLC.

10. General Conditions

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including but not limited to fraud, virus, bug, worm, unauthorized human intervention, or other technical problem, or if the Sweepstakes is unable to run as planned for any other reason, as determined by College Transitions LLC (“Sponsor”) in its sole discretion, the Sponsor may, in its sole discretion: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner.

Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may violate criminal and civil law. Should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees) and any other remedies from any such person to the fullest extent permitted by law.

Failure by College Transitions LLC to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

11. Release and Limitations of Liability

By participating in the Sweepstakes, Entrants agree to release and hold harmless College Transitions LLC (“Sponsor”) and its parents, subsidiaries, affiliates, advertising and promotion agencies, service providers, and each of their respective officers, directors, employees, shareholders, representatives, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt, acceptance, possession, use, or misuse of the prize (including any travel or activity related thereto). This release includes, without limitation:

a) any technical errors associated with the Sweepstakes, including lost, interrupted, or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections; miscommunications; or failed computer, satellite, telephone, cellular, tower, or cable transmissions;
b) unauthorized human intervention in the Sweepstakes;
c) mechanical, network, electronic, computer, human, printing, or typographical errors;
d) issues relating to the downloading, uploading, or processing of entry materials;
e) any other technical or administrative errors or problems in connection with the Sweepstakes, including errors that may occur in the administration of the Sweepstakes, the processing of entries, or the announcement of the winner; or
f) injury, death, losses, or damages of any kind, to persons or property, which may be caused, directly or indirectly, in whole or in part, by participation in the Sweepstakes or acceptance, receipt, use, or misuse of the prize (including any travel or activity related thereto).

Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Entrant be entitled to recover attorneys’ fees. The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, unauthorized access, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including but not limited to punitive, consequential, direct, or indirect damages.

12. Governing Law

All Sweepstakes operated by College Transitions LLC and these Official Rules, along with any additional or supplementary rules, terms, or conditions provided on the Sweepstakes Page, shall be governed by, construed, and interpreted in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any choice-of-law or conflict-of-laws rules (whether of the Commonwealth of Pennsylvania or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the Commonwealth of Pennsylvania.

13. Disputes

Except where prohibited, each Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court located in the Commonwealth of Pennsylvania. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, the rights and obligations of Entrants, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any choice-of-law or conflict-of-laws rules that would cause the application of the laws of any jurisdiction other than Pennsylvania.

Should a dispute arise regarding the identity of an Entrant, the entry will be deemed submitted by the authorized account holder of the email address used to enter. The authorized account holder is the natural person to whom the email address is assigned by an Internet access provider, service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

A potential winner may be required to provide College Transitions LLC with proof that he or she is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements have been met. Failure to provide such proof may result in disqualification, at the sole discretion of College Transitions LLC.

14. Privacy

By entering the Sweepstakes and providing the required entry information, Entrants acknowledge that College Transitions LLC (“Sponsor”) may send newsletters, information, or special offers that Sponsor believes may be of interest to the Entrant, in accordance with College Transitions LLC’s Privacy Policy. Personal information collected from Entrants is subject to College Transitions LLC’s Privacy Policy, which is available on gateway.collegetransitions.com.

16. Taxes

The final value of any prize awarded to a winner will be reported for tax purposes as required by law. The potential winner may be required to provide the Sponsor with a completed IRS Form W-9, valid government identification, and a valid taxpayer identification number or Social Security number before any prize will be awarded. Any person who wins six hundred dollars ($600.00) or more in prizes from College Transitions LLC during a calendar year will receive an IRS Form 1099-MISC (or successor form) at the end of that calendar year, and a copy of such form will be filed with the Internal Revenue Service.

College Transitions LLC is not responsible for any personal, income, federal, state, local, judicial, or other taxes imposed on the winner’s prize winnings.
